Mediation is voluntary, so you will need the agreement of the other party to your dispute to mediate.
Don't despair, you may not agree on your dispute, but as Mr Justice Lightman has said, where mediation is available, "no sane or conscientious litigators or party will lightly reject it"! And if they don't agree now, chances are that their lawyers or a judge may tell them to think again before too long (though you may both have wasted a lot of money on legal costs in the mean time).
